Abstract

The logic of self-regulation is that government safety program mandates cause management to improve safety communication and training on each work site. This, in turn, lessens the need for government intervention. This study introduces self-regulation theory to the economics of safety and health and provides a detailed investigation of the relationships between safety programs, unions, size of establishment, and government enforcement pressure in the construction industry. Using inspection records in New York State between 1987 and 1993, this study finds that non-union establishments were more likely than union to violate the construction safety program standard, given an inspection. Unionization was a significant factor reducing program violations, controlling for establishment and enforcement characteristics. Safety programs were associated with increased worker participation where unions were present. These findings indicate that self-regulation on construction safety may only be possible when unions or other worker protections exist to ensure compliance. Specific recommendations to improve compliance with the standard are made.
